Starting today millions of music lovers across the nation will have to go without there favorite music songs latest tracks as the Calcutta High court has passed an order to all ISP’s and Mobile services services providers for banning songs.pk from being accessed by the subscribers .
This would imply that all mobile and landlines internet users would not be able to visit songs.pk and download the favorite songs.
As per the petition filled by sagarika music pvt ltd before the Calcutta high court ( Case Numbers 187&23 of 2012 Dated 27 Jan) all ISP’s have been directed to block access to the website songs.pk by any of the following methods:
- DNS name blocking
- IP address blocking via routers
-DPI based URL blocking
Our Take: The fact is our Govt is turning paranoid and in spite of being a democratic state Govt is behaving like China. They are pushing Google and Facebook to remove objectionable stuffs. Now who is to define non-appropiate stuffs?
Secondly this order will not affect most of users, as this court order is directed to Dishnet Wireless, Reliance WiMax, Hathway Cable & Datacom Pvt Ltd, Hughes Communications India, Tata Tele (Maharastra), Reliance World, Wipro Ltd, Sify Technologies Ltd, Bharti Airtel, Vodafone India, BG Broadband (now You Telecom). So those are using ISPs other than these will have full access to the site. More importantly there are plenty of such sites offering music downloads.

Here is the ORDER of Calcutta High Court:
This is an application by the plaintiffs in aid of a suit complaining
of copyright infringement. The plaintiff no. 1 and the members of the
plaintiff no. 2 are the copyright owners of Hindi film songs. It is argued
that the website mentioned in the prayers are posting and playing the
songs, without any copyright or licence.
This application is made ex parte on the apprehension that if
notice of this application was served on the website they would shift their
service to a different website.
In those circumstances, I pass an order of injunction in terms of
prayer (a) of the Notice of Motion till further orders. I direct the respondent
ISPs to indicate to the plaintiff the address of the website owner/operator
referred to in the prayers.
I also make it clear that the above order of blocking should be
confined to the above website only and should not otherwise interfere with
internet service.
List this application on 6th February 2012 for further consideration.
All parties are to act on a signed photocopy of this order on the
usual undertakings.

Democracy does not mean rule of law not prevail. If we have a right to free speech, that doesn’t imply that we can say whatever we want and get away with it, we cannot speak evil of women or reserved class or slander against any particular person for that matter. It is good that rights of people are protected blatant voilation of laws will lead to chaos and that is dangerous to a communist country as well as a democracy. Tomorrow if someone argues that child pornography should be allowed, will you stand for it? No one will and thats how law should prevail.

Well said, India should NOT censor internet like China. If censoring starts, then there will be no end to this crap. In fact whole of USA acted to stop SOPA/PIPA and now whole of Europe (lot of member countries) is demonstrating against ACTA.
Government can’t filter results and should not. Who know what they will filter next? First they will censor sites like these and then say some lame reason and block vocal political sites and who knows they might even block google!

GREAT MOVE BY COURT!!!!!! I m very happy that songs.pk will be blocked (i hope it would be implemented ASAP) coz of folowin reasons.
1.Almost 99% ppl visit songs.pk for download. Music is ours, indian, and see who is publishing it and making profit.
2. Music from dat f***ing site has annoying tags everywher. Songs ke naam ke badle mei jyada http://www.songs.pk hai.
I dont think this will effect ppl in any way coz songs are available on many sites, torrents etc.
Boss, there should be a start. Haat pe haat rekhe bethnese to acha hai to start taking action. thousands of crimes happen everyday. doesnt mean police shud stop their duty saying yeh toh roj ka maamla hai…

The courts reacting very fast for business related cases than the people needs and civil related cases. what they want to achieve by banning these sites? People know the proxy and torrents which the courts cant avoid any way. There will be billions of sites like this in another five years, then what they will do?

But surprisingly the ISP list does not include the Internet backbone of India- BSNL.
